Welcome to Unity Wireless. Thank you for choosing us as your service provider. We are pleased to have you as a customer, and we look forward to providing you with the best wireless Service. Please read these terms carefully as these Terms and Conditions of Service become effective by activating or using a Unity Wireless phone. It is a legally binding agreement between you and Unity Wireless. These Terms and Conditions of Service contain important information about your consumer rights. Unity Wireless reserves the right to change or modify the Terms and Conditions of Service at any time and its sole discretion. Changes made to the Terms and Conditions of Service will become effective at the time the change is posted on the Unity Wireless website atwww.gounitywireless.com. Please check this website often for updates to the Terms and Conditions of Service. By enrolling in the Unity Wireless Lifeline and A.C.P. Programs and using the Unity Wireless Service, you, the participant, acknowledge and agree to the following terms and conditions. If you disagree with any item, please immediately discontinue the Services and contact Unity Wireless Customer Support at +1 (800) 701-9262 or email support@gounitywireless.com to terminate.

 

1. Affordable Connectivity Program Terms & Conditions

Lifeline program participants are eligible to participate in the new federal government-funded Affordable Connectivity (A.C.P.) Program enrollment opened on December 31, 2021.

The Affordable Connectivity or A.C.P. Program is a limited-time program that provides discounts on monthly broadband Internet access service and specific connected devices. A.C.P. Program discounts are funded by the U.S. Government's Coronavirus relief effort and administered by the Federal Communications Commission (F.C.C.). This program is separate from the U.S. Government's Lifeline program. Still, your benefits can be combined to receive Unity's Data, talk & text for FREE every month while the program remains open. Of course, our standard terms and conditions apply.

The Affordable Connectivity monthly service and device discounts are non-transferable. An eligible household is limited to one monthly service discount and one device discount. A.C.P. Program benefits may be obtained from any participating provider, and your monthly service benefit may be transferred to another provider at any time.

You may opt-in for the Affordable Connectivity at the time of enrollment with Unity Wireless or anytime after that. Existing customers can also opt in by replying to the opt-in SMS, opt-in mail, or opt-in email. By opting in, you attest that you have read and understand the disclosures described on this page and that you agree to these A.C.P. Terms and Conditions, and that you are opting in to receive your A.C.P. discounted broadband service from Unity Wireless.

By opting-in to the A.C.P., you authorize Unity Wireless and its contracted partners, for the purpose of applying for, determining eligibility, enrolling in and seeking reimbursement of Affordable Connectivity Program (ACPP) service & device benefits, to collect, use, share and retain your personal information, including but not limited to information required for the purpose of establishing eligibility for and enrolling in the Lifeline program, and including, but not limited to, full name, full residential address, date of birth, social security number, telephone number, eligibility criteria and status, the date on which the ACPP service discount was initiated and if applicable, terminated, ACPP connected Device distribution date/type/make and model/status, usage status and other compliance requirements, the amount of support being sought for the Service and/or Device, and information necessary to establish identity and verifiable address, to the Universal Service Administrative Company (USAC) to ensure proper administration of the ACPP service and/or connected device benefits. Failure to consent will result in your being denied the Affordable Connectivity service and the corresponding device benefits.

You agree that any state, local, Tribal government, school, or school district may share information about your receipt of benefits that would establish eligibility for the A.C.P. Such information will be used only to determine A.C.P. eligibility.

You give express consent for Unity Wireless and its contracted partners to contact you to validate your eligibility for or desire to participate in Unity Wireless's A.C.P. offers and other products and services via email, telephone, or text messaging. Text messaging and data rates may apply.


Service Offer

As part of the Lifeline and A.C.P. plan, Unity Wireless will provide eligible consumers with an allocated amount of FREE Data, Talk, and Text to be used monthly. The number of minutes and data supplied to a subscriber is limited; however, a subscriber can contact Unity Wireless' Customer Service Department at +1 (800) 701-9262 or by email at support@gounitywireless.com to receive free additional data or minutes for the remainder of the monthly period.

Device offer
Unity will make applicable devices available to ACP-enrolled subscribers for a reasonable price for commitment and a fair price for no obligation. Responsibility is to commit to 120 day's Service with Unity. If the subscriber decides to terminate the Service before 120 days of Service, the subscriber will be responsible for paying $125 for the cost of the Device they receive. The subscriber also agrees that if their A.C.P. is transferred from Unity Wireless to another provider, Unity Wireless can contact them via voice call, SMS message, or email to confirm that they approved the benefit transfer. They may then request to keep their Unity Wireless service and authorize Unity Wireless to transfer their benefit back to Unity Wireless. In addition, unity Wireless may perform functional tests on the devices before shipment to ensure the subscribers can use the Service immediately upon receipt of the devices. The usage with the testing will not count towards subscriber A.C.P.

Expiration date
The A.C.P. program will end after the Public Health Emergency no longer exists or as deemed by the F.C.C. Once the program is over, your plan will revert to the standard Lifeline offer. You may also keep this FREE plan, but it will be subject to the standard rates. We will notify you when there is a change to the program. Our standard terms and conditions will apply.

Eligibility
An individual is eligible if they meet one of the following criteria:

Has an income that is at or below 200% of the federal poverty guidelines;
Participates in specific assistance programs, such as SNAP, Medicaid, Federal Public Housing Assistance, S.S.I., W.I.C., or Lifeline;
Participates in Tribal specific programs, such as Bureau of Indian Affairs General Assistance, Tribal TANF, or Food Distribution Program on Indian Reservations;
Is approved to receive benefits under the free and reduced-price school lunch program or the school breakfast program, including through the USDA Community Eligibility Provision in the 2019-2020, 2020-2021, or 2021-2022 school year;
Received a Federal Pell Grant during the current award year;
Meets the eligibility criteria for a participating provider's existing low-income program.

 

2. Unity Wireless Requirements

Subscribers applying for Service may be required to provide a Social Security Number to certify or verify eligibility for A.C.P. service. (Social Security information is strictly confidential and will not be disclosed to others without a subscriber's written consent). In addition, subscriber affirms they are at least 18 years old.

Subscriber authorizes representatives of any state or federal assistance program to discuss or provide the documentation needed to verify participation requested by Unity Wireless. Subscriber also allows any state or federal assistance program representative to verify the subscriber's eligibility for the Lifeline program.

Subscribers applying for the A.C.P. program authorize Unity Wireless I.N.C. or its duly appointed representatives to have access to records relating to the applicant to verify eligibility for the Unity Wireless A.C.P. service.

3. Annual Recertification, Verification, or Termination of A.C.P. Programs

Subscribers participating in the Unity Wireless A.C.P. program will be automatically recertified annually. Their qualification to continue participating in A.C.P. programs will be based on the appropriate state or federal recertification and after-verification requirements. Every subscriber in the National Verifier recertification will undergo an initial automated data check that will check for the subscriber's eligibility. Subscribers whose eligibility cannot be verified via the initial mechanical assessment will be required to self-certify their eligibility. USAC (Universal Service Administrative Company) will conduct outreach to these subscribers and demand that they self-certify. Subscribers that fail the initial data source checks will be prompted to self-certify during a 60-day window. Failure to self-certify during this time will result in automatic de-enrollment. USAC can determine, at its sole discretion, if a subscriber meets the annual recertification requirements and if the subscriber fails to re-qualify for Lifeline service. If USAC cannot recertify the required A.C.P. qualifications, the subscriber will be deemed ineligible to participate further in the Unity Wireless A.C.P. program.

Unity Wireless reserves the right to cancel or suspend, without notice, a subscriber's account for any fraudulent related reasons or upon the request of any state or federal authority's injunction. Unity Wireless subscribers can terminate the A.C.P. program for any reason. Subscribers who remove the A.C.P. program may send notice of termination to the address or email listed below with their request. Customers also can call the Customer Service number below to de-enroll from A.C.P. service. Identification will be required by providing the customer's Full Name, Unity Wireless Number, D.O.B., and last four numbers of their Social Security Number. Upon termination from the program, subscribers will no longer receive discounted minutes each month. In addition, they will be required to re-qualify for A.C.P. if they enroll in another Unity Wireless A.C.P. program.

If you do not accept these Terms and Conditions of Service, do not activate or use the Service provided by Unity Wireless and contact Unity Wireless Customer Service at +1 (800) 701-9262. By accepting these Terms and Conditions of Service, you represent that you are at least 18 years of age, you meet the eligibility requirements for Unity Wireless service, and you agree that you may not assign your rights or delegate any of your duties under these terms without the prior written consent of Unity Wireless. Any attempted assignment or delegation without proper permission from Unity Wireless shall be void.

4. Supported Services

ACP-supported services are available to Unity Wireless subscribers who participate in A.C.P. Questions regarding supported services can be made in writing to support@gounitywireless.com or by contacting a Unity Wireless representative at +1 (800) 701-9262.

ACP-supported Service includes voice, data, and text services. In addition, supported Service provides access to the emergency services provided by local government or other public safety organizations, such as 911 or enhanced 911, to the extent the provincial government in Unity Wireless service has implemented 911 or E911 Service.

5. Unity Wireless Services

Unity Wireless Service is provided at the company's discretion. Unity Wireless INC. may change pricing or the company's Terms and Conditions of Service, from time to time, without notice. Unless expressly prohibited by law, Unity Wireless reserves the right to modify or cancel a subscriber's Service an account or take corrective action at any time and for any reason, including, but not limited to, violation of any provision of these Terms and Conditions of Service. Check the Unity Wireless website, www.gounitywireless.com, for current pricing and changes to the Terms and Conditions of Service. A subscriber's right to use Unity Wireless service is subject to Unity Wireless business practices, policies, procedures, rates, and Terms and Conditions of Service. Unity Wireless may change the Terms and Conditions of Service at any time. Unity Wireless will notify subscribers of changes to the Terms and Conditions of Service determined to be materially adverse to a subscriber's Service 30 days before the change. If the subscriber does not terminate Service within 30 days of receiving this notice of a change in the Terms and Conditions of Service, the subscriber agrees to accept any such changes.

Unity Wireless I.N.C. provides mobile telecommunications services using the geographic areas of two of America's largest 5G networks. Unity Wireless may deliver ACP-supported services to these areas based on state-authorized licensing sites. Unity Wireless does not guarantee coverage availability in all regions. Local phone numbers may not be available in all areas. Subscribers cannot use Unity Wireless service with any other wireless phone, Device, or on the network. Subscribers may not use a Unity Wireless handset with any other service or network. Airtime may be used for domestic calls from the United States and other benefits as provided in these Terms and Conditions of Service. Unity Wireless service is for personal use and may not be used in a manner that interferes witserviceer Unity Wireless customer service use. Unity Wireless has determined that ability to provide good service to subscribers may be impaired when customers place an abnormally high number of calls, sends or receive an unusually high number of messages, or repeatedly place calls of unusually long duration relative to typical usage by other Unity Wireless customers on similar service plans. Such non-typical usage suggests that a wireless phone is being used for other than personal use and is in violation of these Terms and Conditions of Service. Unity Wireless services are provided solely for live dialogue between two individuals. Unity Wireless services may not be used for monitoring services, data transmissions, or other non-personal related connections that do not consist of uninterrupted live dialogue between two individuals. A Unity Wireless subscriber account may be terminated, without notice, if a subscriber's usage is determined to be used in violation of the Terms and Conditions of Service for non-personal use, pager service, voicemail retrieval service, or other uses deemed inappropriate.

Unity Wireless services use radio transmissions and are therefore affected by limitations. Coverage is not available everywhere. Quality of Service may be affected by conditions beyond Unity Wireless's control, including atmospheric, geographical, or topographical conditions. Assistance may also be affected by damage to wireless handsets. Unity Wireless does not guarantee or warrant that Service will be available at any specific time or geographical location or that Service will be provided without interruption. Therefore, you should never solely rely on your wireless phone for emergency calls, such as 911. Unity Wireless customers have access to dial 911 in an emergency. However, occasionally a subscriber may attempt to call 911 in an area without wireless coverage. If there is no wireless coverage, a subscriber's call to 911 may not go through, and the subscriber should dial 911 from the nearest landline phone.

By applying or activating Service witless, a subscriber agrees not t way use Unity Wireless services in any illegal, abusive, or fraudulent way. This will be determined by Unity Wireless at its sole discretion. You may also not alter any software or hardware on your Unity Wireless handset for any purpose. Unity Wireless phones may not be sold to third parties.

The map is only an approximation of actual coverage and may differ substantially from the areas of coverage shown on the website. The rIn addition, the range can be affected by many factors, such as weather, terrain, buildings, equipment, signal strength, or other factors affecting network coverage. Therefore, unity Wireless does not guarantee coverage or network availability.

6. Unity Wireless E.T.C. Services

Unity Wireless A.C.P. plans are only available for activation by customers who reside in the areas in which Unity Wireless I.N.C. has been designated as an Eligible Telecommunications Carrier' E.T.C.). To receive subsidized wireless Service, a subscriber's principal residence address must be within a Unity Wireless E.T.C. service area. Visit www.gounitywireless.com to check whether you reside in a Unity Wireless E.T.C. service area. To be eligible for Unity Wireless service, a subscriber must meet the applicable eligibility standards described throughout these Terms and Conditions of Service, which may be amended by Unity Wireless. Where applicable, Unity Wireless A.C.P. plans are provided to you by Unity Wireless I.N.C. and are governed by tariffs. Tariffs are on file with the appropriate public utility commissions in each state when required and supersede any term related to the Lifeline Assistance program. Unity Wireless may provide access to tariffs through its website. Please be aware that taxes posted online may not be official documents, and you assume full responsibility for any tariff information you access on the Unity Wireless website. Unity Wireless bears no liability for the accuracy of any records available on this website.

7. Unity Wireless Service Rates (Airtime), Features, Coverage, and Activation Fees

Airtime charges apply to standard voice usage calls for local and domestic long-distance calls. Unity Wireless voice usage is deducted in full-minute increments, and all partial minutes are rounded up to the next minute. Airtime usage is rounded up to the nearest whole minute. Airtime applies to all message retrieval and voice calls. Unanswered outbound calls will be billed if the ring time exceeds 30 seconds. Ring time is defined as when a call is initiated (pressing the TALK button) and when it is answered (or terminated before being answered). Credits will not be given for dropped calls. Any unused airtime that expires is forfeited upon expiration or termination of eligibility in the Unity Wireless A.C.P. Assistance program. A Unity Wireless customer must have airtime minutes to make or receive a call. Unity Wireless handsets will only create or receive calls when you have airtime minutes available on your wireless account. If you run out of airtime, you may purchase and add additional airtime to your account.

INTERNATIONAL DIALING: International calling is not allowed on any Unity Wireless Plan unless you have purchased an international calling plan. Unity Wireless currently offers international calling to Canada, Mexico, Argentina, Brazil, Colombia, Costa Rica, Guadeloupe, Paraguay, Peru, and Venezuela.


Unity Wireless Additional Minutes & Data Plans: Unity Wireless may offer Additional Data Plans for purchase. Please visit www.gounitywireless.com for the current rates of adding additional data rate plans. If you use your monthly data before a new monthly cycle starts and add Data Offering Plan to your account, you will be charged based on the Data Offering Plan you choose for data. Subscribers may add Data Offering Plan to their Unity Wireless account online or over the phone to their account by paying by credit/debit card. Unity Wireless Additional Data Offering Plans come in various increments. Sales taxes may apply and may be added to the minute plan purchased. All data plans offered by Unity Wireless include a limit (C.A.P.) on the amount of data a subscriber can use. Purchased Data Plans cannot be transferred or applied to any other wireless service or account.

Unity Wireless Calling Features include Caller ID, Call Waiting, Three-Way Calling, Call Forwarding, and Voicemail. Caller ID may display your billing name and wireless number when placing outbound calls. Unfortunately, unity Wireless cannot block your name and number when making outbound calls.

Subscribers who successfully submit a Unity Wireless application A.C.P. are eligible to receive a Free SIM card with Service and may qualify for a smart tablet with a co-pay of $10.01. Unity Wireless reserves the right to determine, at its sole discretion, whether or not an applicant meets the eligibility requirements to participate or continue participating in the Unity Wireless A.C.P. program.

About Data Services & Content: Our data Services and your Device participating access the Internet, text, pictures, video, games, graphics, music, email, applications, sound, and other materials ("Data Content") or send Data Content elsewhere. Some Data Content is available from our vendors or us, while other Data Content can be accessed from others (for example, third-party websites, games, ringers, applications, etc.). We make no guarantees about the Data Content you access on your Device. Data Content may be (1) unsuitable for children/minors; (2) unreliable or inaccurate; or (3) offensive, indecent, or objectionable. You are solely responsible for evaluating the Data Content accessed by you or anyone through your Services. We strongly recommend that you monitor your data usage by children/minors. Data Content from third parties may also harm your Device or its software. We are not responsible for any Data Content. We are not responsible for any damage caused by any Data Content you access through the Services that you load on your Device or request that our representative access or load on your Device. To protect our networks and Services or for other reasons, we may restrict access to specific Data Content (such as certain websites, applications, etc.); impose separate charges; limit throughput or the amount of data you can transfer; or otherwise modify or terminate Services. If we provide you storage for Data Content that you have purchased, then we may delete the Data Content without notice or place restrictions/limits on the use of storage areas. Data Content stored on a Device, transmitted over our networks, or held by Access Wireless may be deleted, modified, or damaged. You may not be able to make or receive voice calls while using data Services. Data Content provided by our vendors or third parties is subject to cancellation or termination at any time without notice. You may not receive a refund for any unused portion of the Data Content.

Specific Terms & Restrictions On Using Data Services: In addition to the rules for using all of our other Services, unless we identify the Service or Device that you have selected as explicitly intended for that purpose (for example, wireless routers, Data Link, etc.), you may not use our data Services: (1) with server devices or host computer applications, or other systems that drive continuous, heavy traffic or data sessions; (2) as a substitute or backup for private lines or frame relay connections; or (3) for any other unintended use as we determine in our sole discretion. We reserve the right to limit, suspend, or constrain any heavy, continuous data usage that adversely impacts our networks' performance or hinders access to our networks. For example, suppose your Services include Web or data entry. In that case, you also can't use your Device as a modem for computers or other equipment unless we identify the Service or Device you have selected as explicitly intended for that purpose (for example, with "phone as modem" plans, broadband internet access service, mobile broadband card plans, wireless router plans, etc...).

Porting/Transferring a Phone Number: We do not guarantee that number transfers to or from us will be successful. For example, suppose you authorize another carrier to transfer a number from us. In that case, that is considered a request by you to us to terminate all of the Services associated with that number.

8. Unity Wireless Taxes and Surcharges

Unity Wireless charges state and local sales taxes. Pricing listed on the Unity  Wireless website or in advertising methods for wireless Service may not include certain taxes, or our service users are responsible for all charges applicable to the use of Unity Wireless service regardless if the subscriber was a user of the Service. The amount of these taxes and surcharges are subject to change and may vary by geogThe third area. Unity Wireless may collect sales taxes and regulatory fees on all Additional Minutes or Data Offering Plans in each state. The third-party authorized retailers who sell Unity Wireless Additional Minutes or Data Offerithird-party become responsible for collecting and paying sales taxes and required regulatory fees for transactions that occur through such third-party authorized retailers. Changes to a tax or surcharge will become effective as provided by the appropriate taxing authority, and changes to applicable contribution amounts for Federal Universal Service Fund ("FUSF") will apply. Taxes and fees are subject to change without notice.

Unity Wireless Text Messaging Rates

A Unity Wireless subscriber can send and receive text messages of up to 160 characters. This text message includes the address and subject line. The type of messages a device can receive will depend on the wireless handset's capabilities. Standard plan message rates apply when sending or receiving text messages, regardless of if the message is viewed. Any new messages that expire from one monthly billing cycle will not carry over to the next monthly billing cycle unless the monthly plan explicitly allows carry-over messages. Text messages sent to you by Unity Wireless are free of charge.

A Unity Wireless subscriber can send and receive text messages of up to 160 characters. This text message includes the address and subject line. Domestic Text Messaging Rates: Any new messages will expire at the end of your monthly subscription period and will not be applied to subsequently purchased minutes unless your plan includes rollover minutes. Subscriber messaging plans do not have international text or voicemail messages.

International Text Messaging Rates: Unity Wireless does not allow international text messages. Attempting to send international messages could result in the deactivation of Service and de-enrollment from Unity Wireless service.

Premium SMS: Premium SMS is a text message to a designated "shortcode." Buying or attempting from anyone other than Unity Wireless is strictly prohibited. Premium SMS campaigns may inclinteractingending a vote, play a game, express opinions, subscribe to some Service, or interacting with a television program. Unity Wireless does not participate in Premium SMS services or campaigns. You are solely responsible for any charges incurred for Premium SMS services or drives. Any text messages sent to a "short code" using Unity Wireless service will not likely be successfully sent or received. Any charges you may incur as a result of any attempts to participate in Premium SMS campaigns or services are not refundable, regardless of whether you incur costs as deductions from your Unity Wireless minutes.

9. Preventing or Sending Spam:

Unity Wireless subscribers receiving unwanted text messages ('spam') should contact the source and request to unsubscribe or remove the subscriber's wireless phone number from the Service. If a Unity Wireless subscriber intentionally sends Spam from a Unity Wireless handset, the subscriber may be terminated without notice. Unity Wireless may send messages via SMS to your Unity Wireless handset or alternative phone number.

10. Unity Wireless instead, directory assistance, Additional Charges, and Services

Directory assistance calls are not charged at a rate per call. Directory assistance calls are deducted from the subscriber's available minutes at 1:1. Unity Wireless reserves the right to access a rate per call in the future. Notice of such will be added to these Terms of Service and will be posted to our, Therefore, unity.

Calls to 900 / 976 or other pay-per-call service numbers are unavailable to Unity Wireless subscribers. Therefore, unity Wireless will block calls to 1-900, 1-976, some international calling, or other pay-per-call services. However, if any charges are received by Unity Wireless from the underlining carrier for these calls, these charges will be passed through to the end user for payment. Nonpayment of these charges, when billed to the subscriber, will constitute automatic disconnection of Service.

Calls placed to 800/866/877 or other toll-free numbers will incur standard minute usage of a 1:1 ratio. Unity Wireless allows subscribers to make or receive domestic long-distance calls inside the U.S.A. as long as coverage is available. Unity Wireless does not allow free calls to other subscribers using Unity Wireless service. Unity Wireless subscriber handsets do not provide rate information for services used to make or receive voice calls or messages.

12. Unity Wireless Refunds, Returns, or Lost Equipment Policy:

Refunds:
Unity Wireless is not responsible for, nor will we refund, any lost, stolen, misused, or damaged Unity Wireless Additional Minutes or Data Offering Plans. Unity Wireless does not accept returns or provide refunds of any Unity Wireless Additional Minutes or Data Offering Plans unless it is determined Unity Wireless did not perform the duty of Service. All Unity Wireless Additional Minutes or Data Offering Plans purchases are final and non-refundable regardless of who uses or possesses the subscriber's wireless phone after airtime is purchased and irrespective of whether the wireless telephone is used with the subscriber's consent or knowledge. Monthly charges are non-refundable.

Returns:
Wireless handsets purchased directly from or received from Unity Wireless may be returned for a full refund within 15 days of receipt. A subscriber must return the complete handset as received at activation time. For instructions, please get in touch with Unity Wireless Customer Service at +1 (800) 701-9262. Unity Wireless provides new and used handsets to subscribers. All handset models provided to Lifeline subscribers are selected at the sole discretion of Unity Wireless. Handset models may vary. Unity Wireless reserves the right to replace handsets with various models at its sole discretion. All tablets purchased directly from Unity Wireless include a 1-year warranty. Lost or Stolen Equipment:

Suppose a Unity Wireless Subscriber loses or has their handset stolen. In that case, the subscriber is responsible for all charges incurred until Unity Wireless is notified of the lost or stolen wireless phone. To report a lost or stolen wireless phone, contact Unity Wireless's Customer Service at +1 (800) 701-9262 or support@gounitywireless.com. Upon receiving notice of the lost or stolen phone, Unity Wireless will suspend the account immediately if a subscriber does not. In that case, either activate a new Unity Wireless phone or notify us that they have found their wireless phone within 30 days of the suspension of the account; the account will be deducted the subscriber will activate the timeless phone number.

13. Unity Wireless Phone Number

Unity Wireless subscribers must accept the number assigned to them at the activation time. The wireless phone number Unity Wireless provides subscribers are and will remain the property of Unity Wireless. Unity Wireless may release a subscriber's wireless phone number to another subscriber without notice if the subscriber cancels Service with Unity Wireless or if the account expires and is deactivated. Subscribers may transfer a wireless number before the wireless number is reissued to another subscriber. Unity Wireless reserves the right to change a wireless number at any time. Unity Wireless will attempt to notify the subscriber before any change.

In some situations, a subscriber may transfer an existing carrier telephone number to their Unity Wireless service for use as a Unity Wireless phone number. To switch a current phone number to Unity Wireless, please get in touch with Unity Wireless Customer Service at +1 (800) 701-9262. Before calling, please have a bill available from the existing carrier. When subscribers transfer from another wireless carrier to Unity Wireless, they may have to pay a termination fee to the former page to terminate the contract early. Allows subscribers to use theirs for any termination fees imposed by other carriers.

14. Bring Your Phone Program

Unity Wireless allows subscribers to useSupposeheir own mobile phone or device as long as it is compatible with Unity W. In that case, it releases services and networks under it Bring Your Phone Program.

Suppose you are activating your phone under the Bring Your Phone Program. In that case, you are responsible for ensuring that the phone is unlocked, is compatible with the Unity Wireless Lifeline Service, does not interfere with the Unity Wireless Service, and complies with all applicable low purchasing and also maintaining responsible for ensuring that your phone meets all federal laws and standards. You are further responsible for purchasing and maintaining any additional hardware and software required to use the Service. Not all aspects of the Unity Wireless Service will function on - Unity-provided mobile devices, including those activated under the Bring Your Phone program. Additionally, some functions and features available on other carrier networks or referenced in the manufacturer's manual provided with your phone may not be available when using the Unity Wireless Service.

Termination Service

As a Unity Wireless customer, you are eligible to receive Unity Wireless Lifeline Service for up to one (1) year upon your enrollment and using the Device in the Unity Wireless A.C.O. Program. In addition, you are eligible to receive up to another year following each successful Annual Recertification for your continued program eligibility in the Unity Lifeline Program based on your continued eligibility to participate in the program and your continued usage of the Unity Wireless Lifeline Service. If you have no use in 30 days, "Non Usage," you will receive a notice with a fifteen (15) day grace period to correct the non-usage. If you do not respond to the information, you will be de-enrolled, and deactivation of Lifeline Service will occur, regardless of the service end date. Suppose it is found that you no longer meet the requirements or eligibility guidelines to receive Unity Wireless Lifeline Service. In that case, you will be de-enrolled, and deactivation of Unity Wireless Lifeline Service will occur. Unity Wireless will not seek reimbursement for your participation in the Unity Wireless Lifeline Service after 30 days of non-usage. Upon de-enrollment from the Unity Wireless Lifeline Program, you will cease receiving the discounted or free monthly allotment of airtime or Data.

If you exceed 45 days without any usage (as defined consistent with 47 C.F.R. 54.407(c) (2)), you will be de-enrolled from the Unity Wireless Lifeline Program. Any of these activities, if undertaken by the subscriber, will establish "usage" of the Unity Wireless Lifeline service: (i) Completion of an outbound call; (ii) Purchase of Data from Unity Wireless to add to the subscriber's service plan; (iii) Answering an incoming call from a party other than the Unity Wireless or Unity Wireless's agents or representatives; (iv) Responding to direct contact from Unity Wireless and confirming that you want to continue receiving the U Sending a text message.

Unity Wireless's provision at any time during a calendar month of Service begins on the 1st calendar day at any time during a calendar month; a Unity Wireless customer terminates their Service, the customer's Service will be canceled by Unity Wireless's respective policies and procedures.

Limitation of Liability

Unity Wireless INC. will not be liable to you (subscriber) for any direct or indirect, special, incidental, consequential, exemplary, or punitive damages of any kind, including lost or potential profits (regardless of whether it has been notified such loss may occur) because of any act or omission in its provision of equipment and Services. Unity Wireless LLC. will not be liable for any act or omission of any other company furnishing a part of our services or equipment or for any damages resulting from any service or equipment provided by or manufactured by affiliated or non-affiliated third parties. Unity Wireless INC. is not responsible at any time and shall not be liable to you or anyone else for any personal information such as user names, passwords, contacts, pictures, SMS, or any additional content you may have stored on your phone or which may remain on your phone during and after you no longer have Serviced with Unity Wireless. Unless prohibited by law, you (subscriber) agree to limit claims for damages or other monetary relief against each other No fiduciary duty Wireless assumes no risk or responsibility for a subscriber's use of any content provided by Unity Wireless services. No fiduciary duty exists between you (subscriber) and Unity Wireless, INC. or its affiliates. You (subscriber) also agree that Unity Wireless will not be liable for any missed voicemails, any messages from your voicemail system, any data content, or any storage or deletion of contacts from a handset address book provided by Unity Wireless.

15. Use of Unity Wireless Customer Information

By agreeing to the Terms and Conditions of Service herein, you also agree to the terms of Unity Wireless Privacy Policy available online at https://gounitywireless.com. The Privacy Policy may change from time to time and includes essential information on what data we collect about you, how we use this data, and with whom we share that data. Customer Proprietary Network Information (CPNI) is information that Unity Wireless obtains when providing your telecommunications services. CPNI includes the types of telecommunications services you currently purchase, how you use them, and the billing information related to those services, including items such as the types of local, long-distance, and wireless telecommunications services you have purchased and your calling details. Your telephone, name, and address are not considered CPNI.

16. Right to Terminate Your Unity Wireless A.C.P./Lifeline Service

You agree not to give away, resell, or offer to resell the Unity Wireless Mobile Device or Service the Unless Lifeline Program provides. You also agree that your Unity Wireless Mobile Device will not be used for any purpose that is not allowed by this agreement or illegal. Unity Wireless can, without notice, limit, suspend, or end your Service and de-enroll you from the Unity Wireless Lifeline Program for violating this provision or for any other reasonable cause, including, but not limited to, if you: (a) violate any of the Terms and Conditions of Service; (b) lie to any representative of Unity Wireless or attempt to defraud any representative of Unity Wireless; (c) allow anyone to tamper with your Unity Wireless Mobile Device; (d) threaten or commit violence against any representative of Unity Wireless, any of our employees or Customer Support Representatives; (e) use vulgar and/or inappropriate language when interacting with Unity Wireless representatives; (f) steal from Unity Wireless; (g) harass Unity Wireless representatives; (h) interfere with Unity Wireless operations; (i) engage in abusive messaging, emailing, or calling; (j) modify your Device from its manufacturer's specification; or (k) use the Service in a way that adversely affects our network or the Service available to Unity Wireless's other customers. We reserve the right to, without notice, limit, suspend or end your Service for any other operational or governmental reason. In addition to permanently terminating your Service, criminal offenses (i.e., selling or giving away your Service, threatening violence, etc.) will be reported to the appropriate legal authorities for prosecution.

17. Unauthorized Usage and Tampering

The Unity Wireless Mobile Device is provided exclusively for use by you, the end consumer, with the Unity Wireless Service available solely in the United States. Any other use of your Unity Wireless Mobile Device, including, but not limited to, resale, unlocking, and re-flashing of the phone, is unauthorized and constitutes a violation of your agreement with Unity Wireless. You agree not to open, re-flash, tamper with, or alter your Unity Wireless Mobile Device or its software; engage in any other unauthorized or illegal use of your Unity Wireless Mobile Device or the Service, or assist others in such acts; or to sell and export Unity Wireless Mobile Devices outside of the United States. These acts violate Unity Wireless's rights and state and federal laws. Improper, illegal, or unauthorized use of your Unity Wireless Mobile Device violates this agreement and may result in immediate discontinuance of services and legal action against you. Unity Wireless will prosecute violators fully of the law.

Some Unity Wireless Mobile Devices have SIM cards. If your Unity Wireless Mobile Device has a SIM card, then you agree to safeguard your SIM card and not to allow any unauthorized person to use your SIM card. You agree not to allow any other person to, directly or indirectly, alter, bypass, copy, deactivate, remove, reverse-engineer, or otherwise circumvent or reproduce the encoded information stored on or the encryption mechanisms of your SIM card. You may not remove your SIM Card from your phone nor place the SIM Card in any other phone. In addition, the so could result in the immediate termination of your Service and de-enrollment from the Unity Wireless Lifeline Program. The Carriers, Unity Wireless, or its service providers may, from time to time, remotely update or change the encoded information on your SIM card. Your Unity Wireless Mobile Device is restricted from operating when you are located outside the United States, including offshore or in international waters. In the event of suspension for this or any other unauthorized usage, you will not be entitled to receive any refunds for unused airtime.

18. Limitations of Service and Use of Equipment

Service is subject to transmission limitations caused by specific equipment and compatibility issues, atmospheric, topographical, and other conditions. Further, Services may be temporarily refused, limited, interrupted, or curtailed due to system capacity limitations, technology migration, or limitations imposed by Unity Wireless or the Carriers or because of equipment modifications, upgrades, repairs, relocations, or other similar activities necessary or proper for the operation or improvement of Unity Wireless or the Carriers' radiotelephone system. At any time, Unity Wireless reserves the right to substitute and replace any Unity Wireless equipment (including Mobile Devices) with other Unity Wireless equipment (including Mobile Devices) of comparable quality. Some functions and features referenced network availability or for a particular Unity Wireless Mobile Device may not be available on your phone. Unity Wireless does not warrant or guarantee the network availability or services at any specific time or geographic location or that the services will be provided without interruption. Unity Wireless does not ensure access to 911 services without or with limited wireless coverage; a subscriber's 911 call may not go through; subscribers should dial 911 from the nearest landline phone. Neither Unity Wireless nor any carrier shall be liable for service failures, outages, or Service limitatServiceecause of the risk of lightning strikes; you should not use your Unity Wireless Mobile Device outside during a lightning storm. Unplugging the Unity Wireless Mobile Device power cord and charger would be best to avoid electrical shock and fire during a lightning storm. Suppose Unity Wireless determines that it is necessary to interrupt the Services for any reason or there is the potential for a Services interruption due to system maintenance. In that case, Unity Wireless will use reasonable efforts to notify you before performing such care. It will attempt to schedule such maintenance during non-peak hours.

19. Law Enforcement

Unity Wireless intends to fully comply with the Communications Assistance for Law Enforcement Act and other similar laws or regulations. By using the Services, you agree that, if and as required by law enforcement entities, Unity Wireless may monitor or facilitate monitoring and otherwise disclose the nature and content of communications transmitted through the Services or the Mobile Device without further notice or liability.

20. Limitation of Liability

Unity Wireless INC. will not be liable to you (subscriber) for any direct or indirect, special, incidental, consequential, exemplary, or punitive damages of any kind, including lost or potential profits (regardless of whether it has been notified such loss may occur) because of any act or omission in its provision of equipment and Services. Unity Wireless LLC. will not be liable for any act or omission of any other company furnishing a part of our services or equipment or for any damages resulting from any service or equipment provided by or manufactured by affiliated or non-affiliated third parties. Unity Wireless INC. is not responsible at any time and shall not be liable to you or anyone else for any personal information such as user names, passwords, contacts, pictures, SMS, or any additional content you may have stored on your phone or which may remain on your phone during and after you no longer have Serviced with Unity Wireless. Unless prohibited by law, you (subscriber) agree to limit claims for damages or other monetary relief against each otto fiduciary duties. Unity Wireless assumes no risk or responsibility for the subscribers' use of any content provided by Unity Wireless services. No fiduciary duty exists between you (subscriber) and Unity Wireless LLC. or its affiliates. You (subscriber) also agree that Unity Wireless will not be liable for any missed voicemails, any messages from your voicemail system, any data content, or any storage or deletion of contacts from a handset address book provided by Unity Wireless.

21. Indemnification

To the full extent by law, you agree to hold harmless and indemnify Unity Wireless INC. and its affiliates, and their respective officers, agents, directors, partners, and employees, from any liabilities, settlements, penalties, claims, causes of action and demands brought by third parties (including any costs, expenses or attorneys' fees on account thereof), directly or indirectly, resulting from your use of Unity Wireless products and services, or another person whom you authorize or not to use your products or services, whether based in contract or tort (including strict liability) and regardless of the form of action. This obligation shall survive any expiration or termination of your Service with Unity Wireless L.L.C.

A subscriber may reside in a state that does not allow disclaimers of implied warranties or limits remedies for breach. Therefore, the above exclusions or limitations may not apply to all subscribers. In addition, a subscriber may have other legal rights that vary by state.

22. Warranties

Unity Wireless customers shall have up to fifth teen (15) days from the delivery date of their Mobile Device to return any defective Mobile Device and accessories to Unity Wireless. Unity Wireless will exchange a bad Mobile Device for a replacement phone at Unity Wireless's discretion. 23. Notices

You may send notices to Unity Wireless by email at support@gounitywireless.com. Messages will be considered adequate after they are received by Unity Wireless. If subscribers cannot resolve concerns with Unity Wireless, they may file a complaint with the Federal Communications Commission or their state commission board. Any notice sent to a subscriber will be sent to your last known residence we have on file via text message to your Unity Wireless phone, text message to your alternative phone, or email to your email.

The Unity Wireless Terms and Conditions of Service, contained herein, supersede all oral or written communications and understandings between you and Unity Wireless concerning products and services provided to you and the terms under which they are offered to you by Unity Wireless. The surviving sections of this Terms and Conditions of Service shall continue to be valid and enforceable if any part of these Terms and Conditions of Service is declared invalid, not applicable, or becomes unenforceable. There are no provisions of these Terms and Conditions of Service that provide any person or entity that is not a party to these Terms and Conditions of Service with any remedy, liability, claim, reimbursement, or any cause of action or that creates any other third-party beneficiary rights. Unless otherwise specified herein, any legal dispute shall be subject to the exclusive jurisdiction of the federal or state courts in Texas. Unity Wireless reserves the right to suspend or terminate any subscriber's access to Unity Wireless services or to the Unity Wireless website or affiliated websites at any time should we determine in our sole discretion that a subscriber has violated any of these Terms and Conditions of Service or any other policy of Unity Wireless, its affiliates, or for any other reason at the sole discretion of Unity Wireless.
